Legal Counsel, Privacy (m/f/d)

Responsibilities *:

- Serve as a key subject matter expert and advisor to PayPal lawyers and business units on privacy and data protection issues in commercial negotiations.

- Draft and negotiatethe privacy and data protection aspects of complex agreements ranging from professional services, development, and supplier agreements with various merchants, partners and vendors.

- Provide training to legal colleagues regarding privacy and data protection issues in commercial matters, as well as develop and maintain guidelines, playbooks, templated terms, and other resources.

- Coordinate with regional lawyers to evaluate and, where appropriate, help design products, services and technologies for compliance with local data privacy regulations.

- Collaborate with Compliance colleagues, the Global Privacy Office and PayPal'sInternational Data Protection Officer (DPO)to develop, enhance and implement the PayPal Global Privacy Frameworkin markets where PayPal operates.

- Support the Global Privacy Office in the continued development and implementation of the PIA and DPIA assessments.

- Advise on new and emerging legal and regulatory developments impacting data privacy and data security, including identifying trends and potential impacts on business activities.

- Collaborate and coordinate with government relations teams to proactively monitor and review privacy and data-protection related legislation tohelp ensure accurate and up-to-date inventories of all legal obligations.

- Participate in the development, implementation, and ongoing privacy compliance monitoring of third-party vendors and partners to ensure all privacy concerns, requirements, and responsibilities are addressed.

- Collaborate with Third Party Management teams and Global Privacy teams on contract process improvement, contract management tool maintenance, data mapping, tracking, and reporting.

- Work with other counsels providing regulatory privacy support for the Global Privacy team in answering customer and other day to day communication of the Global Privacy mailbox including data protection authority enquiries, complaints, and disputes.

- To provide subject matter expert input in connection with regulatory investigations, individual complaints and enquiries received related to GDPR, the management of GDPR individual data subject access rights requests and data retention.

- To provide subject matter expert input in connection with Subpoenas, law enforcement requests, production orders and similar.

- Supporting data protection and privacy aspects of litigation matters for EMEA.

Skills & Experience *:* Candidates for this position should be able to demonstrate experience and competence with the following.

- Deep, demonstrable privacy, data protection, and program management skills and expertise, with an emphasis on financial and/or employee privacy laws. Specific experience with privacy and data protection laws, including CCPA, LGPD, CAN-SPAM, HIPAA, GDPR, e-Privacy Directive, GLBA, and other applicable laws is required.

- Experience providing risk-based and pragmatic resolution of outstanding privacy and data protection aspects of commercial negotiations, leveraging in a quick, concise and commercially focused legal advice.

- In-depth knowledge of cutting-edge IT, web, mobile,and payment ecosystem technologies (especially those used in the collection, storage and analysis of data)and their privacy and data security implications.

- Familiarity with, and strong interest in, financial services technology, mobile and alternative payments, as well as emerging technology.

- Ability to thrive in a fast-paced environment and to tolerate change and ambiguity.?

- Global thinker and demonstrated collaborator, who displays sound and pragmatic legal and business judgment in providing practical advice to clients on privacy and data protection issues.

- Ability to translate legal advice into actionable policies, processes and programs that enable business objectives.

- Facility with a team-based approach to subject matter management and knowledge sharing, and comfortwith a flexible, agile environment that emphasizes collaboration and team performance over management hierarchy.

- Demonstrated ability to work autonomously as well as part of a team, to effectively coach and mentor others (including non-attorneys), and a sense of humor and resiliency, especially under tight deadlines and while managing multiple priorities.

Qualifications *:* In addition to the above Skills & Experience, candidates should possess the following qualifications.

- 3 or more years of PQE either in-house (or in an equivalent setting) or at a reputable law firm.

- Juris Doctorate or equivalent degree. Admitted to a state bar.

- Exceptional writing skills, with attention to detail and ability to generate creative original drafted documents.

- Excellent communication and presentation skills; ability to communicate and help non-experts understand applicable regulations and requirements.

- Experience advising clients in the financial services, legal compliance, mobile payments, internet and technology industries preferred.

- Relevant technical certifications, such as a Certified Information Privacy Professional (CIPP) or other relevant certifications preferred.
